Wyoming Foreclosure Process, Timeline and Redemption (2026)

The Wyoming foreclosure process usually reaches a public sale about 165 to 240 days after the first missed payment, without a lawsuit. You get a notice of intent, 4 weeks of published notice and a mailed notice at least 25 days before the sale, and afterward you have 3 months to redeem the home.

Wyoming is quick to the auction but not quite final at it, which sets it apart in any foreclosure process by state comparison. Most Wyoming home loans are mortgages with a power of sale, which lets the lender foreclose by advertisement and sale instead of filing suit. The notice rules for that route are in chapter 4 of Title 34 of the Wyoming Statutes, and the redemption rules sit in Title 1.

Why Does the Notice of Intent Matter in Wyoming?

The notice of intent is the first letter Wyoming law requires, and it must reach you by certified mail at least 10 days before the lender starts publishing the sale. A notice of intent to foreclose tells you the lender plans to use the power of sale, and it goes to the record owner and to anyone else in possession (§ 34-4-103).

Before it can foreclose by advertisement, the lender must also show that a default triggered the power of sale, that no lawsuit to collect the same debt is pending or unpaid and that the mortgage and every assignment are recorded. If any of those is missing, the advertisement route is not available, so ask a lawyer to check the county records against the notice. The lender proves the mailing by affidavit, which means the date on the green certified-mail card can matter later.

Wyoming Foreclosure Timeline Step by Step

A Wyoming foreclosure by advertisement moves from the federal 120-day wait to a notice of intent, 4 weeks of publication, the sale and a 3-month redemption period. Under 12 CFR 1024.41, the servicer cannot send the first foreclosure notice until the loan is more than 120 days delinquent.

Step What happens Minimum time Rule
1. Missed payments The servicer must wait until the loan is more than 120 days delinquent 120 days 12 CFR 1024.41(f)
2. Notice of intent Certified mail to the record owner and any separate occupant At least 10 days before publication § 34-4-103
3. Mailed notice of sale Certified mail to owner, occupant and junior lienholders of record At least 25 days before the sale § 34-4-104(a)
4. Published notice of sale County newspaper, at least once in each week 4 consecutive weeks § 34-4-104(a)
5. Foreclosure sale Public auction at the time and place in the notice After publication ends § 34-4-104
6. Surplus report Sale results sent if the price exceeded the debt Within 10 business days § 34-4-104(b)
7. Redemption period You can pay to get the home back 3 months (12 for agricultural land) § 1-18-103

Steps 3 and 4 overlap. The mailed notice must go out before the first newspaper run and at least 25 days before the sale, while publication runs for 4 consecutive weeks. Counting the 10 days before publication, the state steps take at least about 5 weeks from the first letter to the auction.

How Long Does Foreclosure Take in Wyoming?

Most Wyoming foreclosures reach a sale about 165 to 240 days after the first missed payment, the 9th shortest typical minimum of the 51 jurisdictions, tied with New Hampshire. Only 8 states start sooner, all of them non-judicial.

The redemption period changes the full picture. Adding 3 months after the sale, the buyer usually cannot take a deed until about 255 days after your first missed payment. That is still far sooner than in South Dakota, where most owners get a full year to redeem after a sheriff’s sale. To the south, the Colorado foreclosure process starts later, at about 240 days and gives the redemption right after a sale to junior lienholders rather than the owner. A complete loss mitigation application sent more than 37 days before the sale keeps the servicer from holding the auction while it is reviewed (12 CFR 1024.41(g)).

How Does Redemption Work in Wyoming?

A Wyoming homeowner can redeem within 3 months from the date of sale by paying the buyer’s price plus 10% a year in interest and certain costs. The rule comes from Wyo. Stat. § 1-18-103, as amended by 2019 House Bill 290, which took effect July 1, 2019.

That right of redemption has a real price tag. On a $200,000 winning bid, redeeming after 2 months costs about $203,300 plus any taxes, assessments or prior liens the buyer paid, each with interest. If you can refinance or sell for more than that, redemption keeps your equity. Agricultural real estate, generally a parcel over 80 acres outside towns and subdivisions or land used mainly for farming, gets 12 months instead.

The same law gave buyers a limited right of entry during redemption, so they can keep the home from “significantly” deteriorating (§ 1-18-111(b)). It applies to premises not occupied by a legal inhabitant, so if you still live in the home, the buyer’s access is narrow. The buyer holds a certificate of sale during this time, and § 34-4-104(b) lets that certificate double as the sale results report when there is a surplus.

What Happens to Surplus Money After a Wyoming Sale?

When a Wyoming foreclosure sale brings in more than the debt, the lender must send you and junior lienholders the sale results within 10 business days. The report must show the amount owed, the winning bidder’s name and the winning bid (§ 34-4-104(b)).

Use that report to work out what is left over. If the winning bid was $240,000 and the debt and costs were $200,000, about $40,000 remains for junior lienholders and then for you. Keep the report, because it is your best record when you or a lawyer ask where the extra money went.

Buying a Wyoming Foreclosure

Wyoming foreclosure buyers bid at public sales advertised for 4 weeks in county newspapers, then wait out the 3-month redemption period before taking a deed. Plan for the owner to redeem, in which case you get your bid back with 10% annual interest rather than the home.

Renters in a foreclosed Wyoming home are covered by the federal Protecting Tenants at Foreclosure Act, which requires at least 90 days’ notice to vacate for a bona fide tenant. Homes sold for unpaid property taxes follow different rules, so look at the Wyoming tax lien sales process before bidding on one.
